The Software Communication Architecture (SCA) is published by the JTNC. This architecture framework was developed to assist in the development of software defined radio communication systems, capturing the benefits of recent technology advances which are expected to greatly enhance interoperability of communication systems and reduce development and deployment costs. The SCA is deliberately designed to meet commercial application requirements as well as those of military applications. A wide cross-section of industry has participated in the development and validation of the SCA.
Also essential for reusability and portability is the standardization of APIs between the waveform software and the radio hardware platform. This permits the waveform software developers to utilize set hardware and services in a portable and consistent style.
THE WEBSITE RESIDES ON A DEPARTMENT OF DEFENSE (DOD)COMPUTER SYSTEM. DOD COMPUTER SYSTEMS MAY BE MONITORED FOR ALL LAWFUL PURPOSES, INCLUDING ENSURING THAT ITS USE IS AUTHORIZED, FOR MANAGEMENT OF THE SYSTEM, TO FACILITATE PROTECTION AGAINST UNAUTHORIZED ACCESS, AND TO VERIFY SECURITY PROCEDURES, SURVIVABILITY, AND OPERATIONAL SECURITY. MONITORING INCLUDES ACTIVE ATTACKS BY AUTHORIZED DOD ENTITIES TO TEST OR VERIFY THE SECURITY OF THE SYSTEM.
1.1 The WEBSITE is intended to provide a localized website where Software Communication Architecture (SCA) Standards, Application Program Interfaces (API’s), and other documentation related to the Joint Tactical Networking Center (JTNC) , hereinafter “DATA”, can be accessed and downloaded by the general public.
1.2 The WEBSITE is operated and maintained by the GOVERNMENT, as represented by JTNC Standards.
1.3 The DATA is an UNCLAS tool and the GOVERNMENT is interested in presenting the DATA to the public, so that interested parties may be aware of the direction GOVERNMENT intends to take as it manages the JTNC program.
1.4 Notwithstanding the above, the GOVERNMENT would like to place certain limitations on the use of the DATA by parties that access the WEBSITE.
2.1 You may download and use the DATA as a result of granting You access to the WEBSITE. You may also modify, reproduce, or reverse engineer the DATA. However, You, Your subcontractors, affiliates, and parent or subsidiary corporations agree that You may not release, perform, display, or disclose the DATA to third parties, or to further distribute the DATA to third parties, without prior written permission of the JTNC, Director. You may, however, provide the link to the WEBSITE to third parties, who may then freely access the DATA on their own behalf under the terms of this AGREEMENT.
2.2 Notwithstanding paragraph 2.1 above, You may not combine DATA that is computer software with any other computer software, whether open source software or otherwise, that might: (i) create, or purport to create, any GOVERNMENT licensing obligations with respect to the resulting DATA/computer software combination; or (ii) grant, or purport to grant, to any third party any rights to or immunities under GOVERNMENT intellectual property or GOVERNMENT data rights to the DATA/computer software combination.
2.3 If You modify the DATA, You agree to deliver such modified DATA to the Government upon written request by the Government within 60 days of such request and any deliveries of the modified DATA to the GOVERNMENT must be delivered with license rights no more restrictive than Government Purpose Rights, as that term is defined in DFARS 252.227-7013 and DFARS 252.227-7014.
2.4 You may use the DATA in the preparation of proposals in response to GOVERNMENT Requests for Proposals. Please be advised, however, that the GOVERNMENT has made and will make the same DATA available to all other parties that are interested in competing in the procurement. With respect to GOVERNMENT contracts that already exist, the DATA may be issued as Government Furnished Information without prior notice to You.
2.5 The disclosure of the DATA does not imply any relinquishment of GOVERNMENT rights that it may have in such DATA. Your access to the WEBSITE does not constitute a grant of any license under any trademark, patent, or copyright on the DATA, or application for same. DATA on the WEBSITE is declared a work of the U.S. GOVERNMENT, and is not subject to copyright protection in the United States. Foreign copyrights may apply.
3.1 THE DATA IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSED, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY THAT THE DATA WILL CONFORM TO SPECIFICATIONS, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR FREEDOM FROM INFRINGEMENT, ANY WARRANTY THAT THE DATA WILL BE ERROR FREE, OR ANY WARRANTY THAT DOCUMENTATION, IF PROVIDED, WILL CONFORM TO THE DATA. THIS AGREEMENT DOES NOT, IN ANY MANNER, CONSTITUTE AN ENDORSEMENT BY GOVERNMENT OR ANY PRIOR RECIPIENT OF ANY RESULTS, RESULTING DESIGNS, HARDWARE, SOFTWARE PRODUCTS OR ANY OTHER APPLICATIONS RESULTING FROM USE OF THE DATA. FURTHER, GOVERNMENT DISCLAIMS ALL WARRANTIES AND LIABILITIES REGARDING THIRD-PARTY SOFTWARE, IF PRESENT IN THE DATA.
3.2 Please feel free to contact the GOVERNMENT if You have suggestions on modifications or improvements to the DATA. However, any technical data or computer software included in such suggestions will not be treated as proprietary. If the GOVERNMENT incorporates Your modifications/improvements into the DATA, it will treat such suggestions/ modifications under the same terms as the DATA.
3.3 This AGREEMENT does not replace or supersede any other written contracts and/or written agreements that You have or will have with the GOVERNMENT. Any inconsistencies in this AGREEMENT will be resolved by giving precedence to the terms and conditions of Your other written contracts and/or written agreements with the GOVERNMENT.
3.4 This AGREEMENT constitutes the entire understanding of the parties. The GOVERNMENT may update the terms of the AGREEMENT from time to time without notice to You.
3.5 Nothing in this AGREEMENT releases You from performance of any contractual requirements in any contracts with the GOVERNMENT.
3.6 If any provision of this AGREEMENT is held to be invalid or unenforceable under applicable law, it will not affect the validity or enforceability of the remainder of the terms of this AGREEMENT.
3.8 THIS AGREEMENT DOES NOT, IN ANY MANNER, CONSTITUTE AN ENDORSEMENT BY GOVERNMENT OF ANY RESULTS, RESULTING DESIGNS, HARDWARE, SOFTWARE OR ANY OTHER APPLICATIONS RESULTING FROM THE USE OF THE DATA UNDER THIS AGREEMENT. THIS AGREEMENT DOES NOT OBLIGATE THE GOVERNMENT IN ANY WAY, SHAPE OR FORM TO AWARD FUTURE PROCUREMENTS TO YOU.
3.9 By clicking on the below, You acknowledge that any modifications that YOU make to the DATA may result in the requirement to obtain some form of export license from the U.S. GOVERNMENT to export the modified DATA from the United States. JTNC neither represents that an export license shall not be required to any modified DATA nor that, if required, it shall be issued. THIS AGREEMENT IS NOT AN EXPORT LICENSE.
