AUTHORITY: PERS-42, ACTING FOR THE CHIEF OF NAVAL PERSONNEL, WILL: A. DETERMINE ELIGIBILITY OF CANDIDATES FOR SSIP; B. ACCEPT WRITTEN AGREEMENTS ON BEHALF OF THE SECRETARY OF THENAVY FROM ELIGIBLE OFFICERS WHO AGREE TO REMAIN ON ACTIVE DUTY FOR THE SPECIFIED TIME PERIOD; AND C. ADMINISTER THE SSIP PROGRAM PURSUANT TO THIS NAVADMIN. 3. SSIP ELIGIBILITY CRITERIA: A. ON ACTIVE DUTY AND ENTITLED TO RECEIVE BASIC PAY. B. HAVE NOT COMPLETED MORE THAN 25 YEARS OF ACTIVE SERVICE (INCLUDING PREVIOUS ENLISTED SERVICE) BY THE END OF THE TERM OF THE CONTRACT. C. PREVIOUSLY NUCLEAR TRAINED AS AN OFFICER, AND POSSESSING THE 1120 DESIGNATOR. D. CURRENTLY SERVING IN PAYGRADES O4 THROUGH O6 (NOT ELIGIBLE UNTIL DATE OF PROMOTION TO O4). E. NO PENDING OR APPROVED RESIGNATION REQUESTS, LATERAL TRANSFER REQUESTS, OR APPLICATIONS TO PROGRAMS WHICH WILL RESULT IN CHANGE OF DESIGNATOR SUCH AS THE PERMANENT MILITARY PROFESSOR (PMP) PROGRAM, OR THE LAW EDUCATION PROGRAM (LEP). F. MEDICALLY QUALIFIED FOR ASSIGNMENT TO SUBMARINE COMMUNITY COGNIZANT BILLETS (1120 AND 1000/1050 CODED) WORLDWIDE. G. NO INVESTIGATIONS, PUNITIVE ADMINISTRATIVE ACTIONS, DFC PROCEEDINGS OR LEGAL ACTIONS IN PROGRESS OR COMPLETED. H. NOT CURRENTLY QUALIFIED FOR THE SUPERVISION, OPERATION OR MAINTENANCE OF NAVAL NUCLEAR PROPULSION PLANTS. DO NOT HOLD NUCLEAR AQDS AND IS NOT ELIGIBLE FOR NOIP. I. OFFICERS WHO HAVE LOST NUCLEAR AQDS DUE TO REFUSAL OF NUCLEAR ASSIGNMENTS (INCLUDING SUBMARINE DH, XO, CO) ARE NOT ELIGIBLE. J. OFFICERS WHO FAIL FINAL SCREENING FOR SUBMARINE DEPARTMENT HEAD ARE NOT ELIGIBLE. 4. APPLICATIONS: THE APPLICATION SHALL BE A WRITTEN AGREEMENT, CONDITIONAL UPON ACCEPTANCE BY CHNAVPERS (UNDER THE CHIEF OF NAVAL OPERATIONS, ACTING FOR SECNAV) TO REMAIN ON ACTIVE DUTY AS AN OFFICER FOR A PERIOD OF ONE, TWO OR THREE YEARS BEYOND THE DATE OF ACCEPTANCE. FOR OFFICERS APPROACHING STATUTORY RETIREMENT, THE TERM OF THE CONTRACT MUST END PRIOR TO THE STATUTORY RETIREMENT DATE. 5. PAYMENT: OFFICERS WHOSE APPLICATIONS ARE ACCEPTED BY CHNAVPERS PRIOR TO THE END OF THEIR EXISTING SERVICE OBLIGATION SHALL BE PAID AS FOLLOWS: A. A NUMBER OF EQUAL ANNUAL INSTALLMENTS EQUAL TO THE NUMBER OF YEARS COVERED BY THE AGREEMENT, THE FIRST UPON COMMENCEMENT OF THE AGREEMENT, AND THE REMAINING PAYMENTS ANNUALLY THEREAFTER. B. RATE OF PAYMENTS IS $10,000 FOR A ONE-YEAR AGREEMENT, $11,000 ANNUALLY FOR A TWO-YEAR AGREEMENT, AND $12,000 ANNUALLY FOR A THREE-YEAR AGREEMENT. C. THERE IS NO PROVISION FOR A LUMP-SUM PAYMENT. D. UPON ACCEPTANCE OF THE AGREEMENT, THE TOTAL AMOUNT AUTHORIZED FOR THE INDIVIDUAL OFFICER BECOMES FIXED. HOWEVER, SHOULD THE AMOUNT PAID TO OFFICERS WHO SUBSEQUENTLY APPLY FOR SSIP BE INCREASED, OFFICERS WITH AN AGREEMENT IN EFFECT AT A LOWER RATE MAY EXECUTE A NEW AGREEMENT AT THE HIGHER RATE. THE LENGTH OF THIS NEW AGREEMENT SHALL BE EQUAL TO OR EXCEED THE REMAINING PERIOD OF THE OFFICER'S EXISTING AGREEMENT, SO LONG AS THE PERIOD OF OBLIGATED SERVICE DOES NOT EXTEND BEYOND THE END OF 25 YEARS OF ACTIVE SERVICE (INCLUDING PRIOR ENLISTED SERVICE), OR BEYOND STATUTORY RETIREMENT. 6. OBLIGATION: THE ONE, TWO OR THREE YEAR SERVICE OBLIGATION INCURRED AS A RESULT OF ACCEPTANCE OF AN APPLICATION FOR SSIP SHALL RUN FROM THE DATE OF ACCEPTANCE BY CHNAVPERS. 7. ASSIGNMENT: OFFICERS WHO RECEIVE SSIP WILL BE ASSIGNED ACCORDING TO THE NEEDS OF THE SUBMARINE FORCE (FOR OFFICERS OF THEIR QUALIFICATION AND EXPERIENCE) WITHOUT AFFECTING THEIR ELIGIBILITY FOR RECEIPT OF THIS SPECIAL PAY. 8. RECOUPMENT: A. IN THE EVENT AN OFFICER WHO HAS RECEIVED SSIP FAILS TO MAINTAIN ELIGIBILITY FOR SUCH SPECIAL PAY AS SET FORTH IN PARAGRAPH 3 OR FAILS TO COMPLETE THE FULL PERIOD OF ADDITIONAL OBLIGATED SERVICE, NO FURTHER ANNUAL PAYMENTS SHALL BE MADE. REFUND OF SUMS PAID SHALL BE REQUIRED ON A PRO RATA BASIS. EXAMPLES OF SUCH SITUATIONS REQUIRING RECOUPMENT ARE: (1) APPROVED REQUEST FOR VOLUNTARY RELEASE FROM THE WRITTEN AGREEMENT IF IT IS DETERMINED BY CHNAVPERS THAT SUCH RELEASE WOULD BE IN THE BEST INTERESTS OF BOTH THE NAVY AND THE OFFICER. (2) APPROVED VOLUNTARY REQUEST FOR RELIEF FROM CURRENT ASSIGNMENT. (3) REFUSAL TO ACCEPT ORDERS. (4) DISABILITY RESULTING FROM MISCONDUCT, WILLFUL NEGLECT, OR INCURRED DURING A PERIOD OF UNAUTHORIZED ABSENCE. (5) MISCONDUCT. (6) APPROVED DETACHMENT FOR CAUSE. (7) SELECTION FOR AND ASSUMPTION OF PAYGRADE O7 (INCLUDING BEING FROCKED). (8) SELECTION FOR LATERAL TRANSFER TO ANOTHER COMMUNITY. (9) SELECTION FOR ENTRY INTO THE PMP PROGRAM OR LAW EDUCATION PROGRAM. B. IF, FOR ANY OF THE FOLLOWING REASONS, THE OFFICER FAILS TO MAINTAIN ELIGIBILITY FOR SSIP AS SET FORTH IN PARAGRAPH 3 OR FAILS TO COMPLETE THE FULL PERIOD OF ADDITIONAL OBLIGATED SERVICE, NO FURTHER PAYMENTS WILL BE MADE BUT RECOUPMENT OF PAYMENTS ALREADY MADE WILL NOT BE REQUIRED: (1) DISABILITY NOT THE RESULT OF MISCONDUCT OR WILLFUL NEGLECT, OR NOT INCURRED DURING A PERIOD OF UNAUTHORIZED ABSENCE. (2) DEATH. (3) SEPARATION FROM THE NAVAL SERVICE BY OPERATION OF LAWS INDEPENDENT OF MISCONDUCT. (4) WHERE PERS-42 DETERMINES THAT WAIVING THE REQUIREMENT TO RECOUP PAYMENTS IS IN THE BEST INTERESTS OF THE UNITED STATES. 9. RATE CHANGES: ANY CHANGE TO THE TOTAL AMOUNT PAYABLE UPON ACCEPTANCE OF NEW AGREEMENTS WILL BE PROMULGATED VIA SEPCOR. 10. SUBMISSION OF APPLICATIONS: A. COMMANDING OFFICERS FORWARD AGREEMENTS SUBMITTED BY OFFICERS DESIRING TO EXTEND THEIR SERVICE OBLIGATION FOR RECEIPT OF SSIP TO PERS-42 ALONG WITH THEIR RECOMMENDATION. B. COMMANDING OFFICERS ENSURE CORRECT PROCEDURES FOR SUBSTANTIATION AND RECORD ENTRIES ARE USED. THE COMMANDING OFFICER MUST CONSIDER ANY PENDING CIRCUMSTANCES THAT COULD RESULT IN INELIGIBILITY PRIOR TO ACTUAL PAYMENT, SUCH AS ACCEPTANCE FOR LATERAL TRANSFER, PENDING MEDICAL DISQUALIFICATION OR DFC PROCEDURES. C. ELIGIBLE OFFICERS MAY SUBMIT APPLICATIONS TO PERS-42 VIA THEIR COMMANDING OFFICERS.
