THE DEPARTMENT OF THE NAVY AUTHORIZES ACCP AS A SUPPLEMENT TO AVIATION CAREER INCENTIVE PAY (ACIP) TO ENHANCE RETENTION OF HIGHLY TRAINED CAREER AVIATION OFFICERS. ACCP IS OFFERED TO AVIATORS WHOSE PERFORMANCE IS SATISFACTORY AND WHO MEET THE ELIGIBILITY REQUIREMENTS SET FORTH IN PARAGRAPH 6. 6. ELIGIBILITY. SUBMISSION AND ACCEPTANCE OF AN ACCP AGREEMENT BY A RESERVE OFFICER ON THE ACTIVE DUTY LIST EXTENDS THE PERIOD OF ACTIVE SERVICE THROUGH THE PERIOD FOR WHICH ACCP IS PAID. 9. APPROVAL PROCESS. ALL APPLICATIONS FOR ACCP WILL BE REVIEWED UPON RECEIPT AND APPROVED BY PERS-43. 10. PAYMENT. AVIATION OFFICERS WHOSE APPLICATIONS ARE APPROVED WILL RECEIVE THEIR INITIAL ACCP PAYMENT UPON THE COMMENCEMENT DATE OF THE ACCP OBLIGATION. PAYMENT OF ACCP WILL BE EXECUTED ANNUALLY BY DIRECT DEPOSIT AT THE RATES SPECIFIED IN PARAGRAPH 6 WITH SUBSEQUENT INSTALLMENTS MADE ON THE ANNIVERSARY OF THE COMMENCEMENT DATE. 11. CONTINUING ELIGIBILITY REQUIREMENTS. PER REFERENCE (C), AN AVIATION OFFICER MUST REMAIN ON ACTIVE DUTY IN AVIATION SERVICE AND MAINTAIN ELIGIBILITY IAW PARAGRAPHS 6 AND 7. IN ADDITION: A. C. DISEASE OR INJURY RESULTING IN INCAPACITATION OR DISABILITY INCURRED THROUGH THE OFFICER'S OWN MISCONDUCT OR NOT IN THE LINE OF DUTY AS DETERMINED IN ACCORDANCE WITH THE MANUAL OF THE JUDGE ADVOCATE GENERAL. F. PUNISHMENT AND/OR CONVICTION UNDER THE UNIFORM CODE OF MILITARY JUSTICE. 13. REPAYMENT/RECOUPMENT NOT REQUIRED. RECOUPMENT OF PAYMENTS ALREADY MADE WILL NOT BE REQUIRED, THE ACCP OBLIGATION WILL BE TERMINATED, AND NO FURTHER ACCP PAYMENTS WILL BE MADE UNDER THE FOLLOWING CIRCUMSTANCES: A. SEPARATION FROM MILITARY SERVICE BY OPERATION OF LAW, OR BY OPERATION OF MILITARY SERVICE OR DEPARTMENT OF DEFENSE (DOD) POLICY, EXCEPT SEPARATIONS FOR CAUSE. B. DISABILITY, INCLUDING MEDICAL GROUNDING OR SUSPENSION, WHICH IS NEITHER THE RESULT OF MISCONDUCT NOR WILLFUL NEGLECT AND IS NOT INCURRED DURING A PERIOD OF UNAUTHORIZED ABSENCE. C. IN THE EVENT OF DEATH, WHICH IS NEITHER THE RESULT OF MISCONDUCT NOR WILLFUL NEGLECT AND IS NOT INCURRED DURING A PERIOD OF UNAUTHORIZED ABSENCE, THE UNPAID PORTION OF THE ACCP CONTRACT WILL BE AWARDED TO THE MEMBER'S ESTATE. D. IN THOSE SPECIAL CASES WHERE PERS-43 DETERMINES THAT WAIVING THE REQUIREMENT TO RECOUP PAYMENTS IS CLEARLY IN THE BEST INTEREST OF THE NAVY. 14. FY-00 ACCP CONTRACT RENEGOTIATION. A. THE FOLLOWING ARE ELIGIBLE FOR RENEGOTIATION: (1) SECOND SEA, DEPARTMENT HEAD, OR NON COMMAND SCREEN O5 CONTRACTS OF 24 MONTHS OR LONGER CAN BE RENEGOTIATED AT THE HIGHER RATES SPECIFIED IN PARA 6. (2) AVIATORS IN YEAR GROUPS 89 AND JUNIOR WILL BE ALLOWED TO RENEGOTIATE FOR LONG-TERM (FIVE YEAR) ACCP CONTRACTS PROVIDED THEY WERE NOT ELIGIBLE FOR A BONUS PRIOR TO FY-00. (3) TRARON AND TACRON XO/CO 24 MONTH CONTRACTS MAY BE EXTENDED TO 36 MONTHS PER PARA 6. B. THE FOLLOWING LEGAL AND POLICY GUIDELINES APPLY TO ACCP RENEGOTIATION (AND EXTENSION OF TRARON/TACRON XO/CO CONTRACTS): (1) APPLICATIONS FOR RENEGOTIATION/EXTENSION MUST BE RECEIVED BY PERS 43 WITHIN 60 DAYS FROM THE DTG OF THIS NAVADMIN. (2) BY LAW, AN OFFICER CAN BE UNDER ONLY ONE BONUS CONTRACT AT A TIME. (3) ANY EXISTING ACCP CONTRACT MUST BE TERMINATED PRIOR TO RENEGOTIATING A NEW CONTRACT AT A HIGHER RATE. (4) RENEGOTIATION APPLIES ONLY TO FY-00 ACCP CONTRACTS. FY-99 AND PRIOR ACP/BONUS CONTRACTS CANNOT BE RENEGOTIATED OR EXTENDED. (5) TO BE ACCOMPLISHED SIMULTANEOUSLY WITH INITIAL PAYMENT OF RENEGOTIATED ACCP AGREEMENT, UNEARNED PORTION OF PRIOR ACCP PAYMENTS MUST BE RECOUPED ON A PRO-RATED BASIS. (SEE PARA C BELOW.) (6) THE EFFECTIVE DATE OF THE NEW ACCP AGREEMENT (ACCP OBLIGATION) BEGINS ON THE DATE OF ACCEPTANCE OF THE RENEGOTIATED CONTRACT. (7) RENEGOTIATED SHORT-TERM CONTRACTS WILL BE OF THE SAME DURATION AS PREVIOUS ACCP CONTRACT (24 OR 30 MONTHS, AS APPLICABLE). (8) AVIATORS CURRENTLY UNDER 12 MONTH ACCP CONTRACTS WILL NOT BE ELIGIBLE TO RENEGOTIATE OR EXTEND. (9) ACCP RENEGOTIATION WILL ONLY BE ALLOWED FOR CONTRACT UPGRADE TO A HIGHER RATE, AND MAY NOT BE USED FOR EARLY TERMINATION OF CURRENT ACCP OBLIGATION. C. ANY ELIGIBLE OFFICER DESIRING TO RENEGOTIATE MAY APPLY USING THE FORMAT SPECIFIED IN PARA 18. DFAS WILL ADMINISTRATIVELY ORCHESTRATE RECOUPMENT BY DEDUCTING APPROPRIATE AMOUNT FROM INITIAL PAYMENT OF RENEGOTIATED CONTRACT. WHILE RECOUPMENT OF UNEARNED PORTION OF PRIOR ACCP CONTRACT IS A LEGAL REQUIREMENT, EVERY EFFORT HAS BEEN MADE TO MAKE THIS PROCEDURE AS TRANSPARENT AS POSSIBLE TO THE APPLICANT. OFFICERS WHO RENEGOTIATE SHOULD MAKE THEMSELVES AWARE OF THE TAX IMPLICATIONS, IF ANY, OF REPAYING UNEARNED BONUS AMOUNTS AND RECEIVING ADDITIONAL PAYMENTS. 15. ACTION. COMMANDING OFFICERS SHALL ENCOURAGE QUALIFIED AVIATORS TO SUBMIT APPLICATIONS FOR ACCP TO CNPC (PERS-43). COMMANDING OFFICERS MUST ENSURE THAT THE INFORMATION PROVIDED IN THE OFFICER'S APPLICATION IS COMPLETE AND ACCURATE, THAT THE OFFICER MEETS ALL THE ELIGIBILITY REQUIREMENTS SPECIFIED IN PARAGRAPHS 6 AND 7, AND THAT NO ACTION THAT MAY RESULT IN THE OFFICER BEING INELIGIBLE FOR ACCP IS PENDING.
